Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using pixisite.com (the "Site") or purchasing any services, templates, or courses from Pixi Site ("we", "us", "our"). By placing an order, purchasing a template, enrolling in a course, or otherwise using the Site, you ("you", "the Client", "the Customer") agree to be bound by these Terms.
These Terms are governed by the laws of New Zealand.
1. About Us
Pixi Site provides:
Custom website design services (primarily using Squarespace and Shopify)
Digital Squarespace website templates and template kits, available as instant downloads
Online courses and workshops related to website design and digital marketing
We are not affiliated with, endorsed by, or officially connected to Squarespace, Inc. or Shopify Inc. "Squarespace" and "Shopify" are trademarks of their respective owners, and any custom or template websites we build run on their platforms subject to their own separate terms of service, which you are responsible for reviewing and agreeing to independently.
2. Custom Website Design Services
2.1 Scope of work. The specific services, deliverables, timeline, and price for a custom website project will be set out in a separate quote, proposal, or service agreement ("Project Agreement") provided to you before work begins. These Terms apply in addition to, and alongside, any Project Agreement.
2.2 Client responsibilities. You agree to provide content (text, images, branding, logins, and any other materials we reasonably request) in a timely manner. Delays in providing content or feedback may delay project timelines, and we are not responsible for delays caused by late or incomplete client input.
2.3 Revisions. The number of included revision rounds will be specified in your Project Agreement. Additional revisions beyond what is included may be charged at our then-current hourly rate.
2.4 Payment. Custom projects typically require a non-refundable deposit to secure your project slot, with the balance due as outlined in your Project Agreement (e.g., on completion or in milestone payments). Work will not commence, and files/website access will not be handed over, until payment has been received in full, unless otherwise agreed in writing.
2.5 Third-party costs. Costs for third-party services (e.g., Squarespace or Shopify subscriptions, domain registration, stock imagery, fonts, plugins, or apps) are your responsibility unless expressly included in your Project Agreement.
2.6 Ownership on completion. Once paid in full, you own the final website design as built for you, excluding any third-party elements (fonts, stock images, plugins, code libraries) which remain subject to their own licences. We retain the right to display the completed project in our portfolio and marketing materials unless you request otherwise in writing.
3. Digital Templates
3.1 Licence, not sale. When you purchase a template from Pixi Site, you are purchasing a limited, non-exclusive, non-transferable licence to use that template for one (1) website/business, whether for yourself or a single client, not the underlying design or code itself.
3.2 Permitted use. You may:
Customise the template for your own website or a single client project
Use the accompanying course materials to help you set it up
3.3 Not permitted. You may not:
Resell, redistribute, sublicense, or share the template files (including modified versions) with any third party
Use a single template purchase across multiple unrelated websites or businesses
Claim the original template design as your own original creation for resale purposes
Use the template to create a competing template product
3.4 Digital delivery and refunds. Because templates are delivered digitally and access is granted immediately on purchase, all template sales are final and non-refundable once the files or course access have been delivered/accessed, except as required by law (see Section 6).
3.5 Support. Any support included with your template purchase (e.g., email support, tutorials) is as described on the relevant product page at the time of purchase.
4. Online Courses and Workshops
4.1 Access. On successful payment, you will receive access to the relevant course content, typically via a hosted platform. Access duration (lifetime, 12 months, etc.) will be specified on the relevant course/product page.
4.2 Personal use only. Course content is for your personal or single-business use only and may not be shared, reproduced, or distributed to others.
4.3 Refunds. Due to the digital and immediately-accessible nature of course content, courses are non-refundable once access has been granted, except as required by law (see Section 6). If you believe you were charged in error, contact us within 7 days of purchase.
4.4 No guaranteed results. Course content is educational in nature. We do not guarantee specific business, sales, or ranking outcomes from completing a course.
5. Payments
5.1 All prices are listed in New Zealand Dollars (NZD) unless stated otherwise, and are inclusive of GST where applicable, unless stated otherwise.
5.2 Payments are processed securely through our third-party payment providers. We do not store your full payment card details.
5.3 We reserve the right to change prices at any time, but changes will not affect orders already placed.
6. Refund Policy
6.1 Because our products and services are largely digital or highly customised, our general position is:
Custom website design: Deposits are non-refundable. Refunds for milestone payments considered case-by-case if work has not commenced. No refunds once a website has been completed and delivered.
Digital templates: Non-refundable once files are delivered/downloaded.
Online courses: Non-refundable once access is granted, subject to 6.3 below.
6.2 Faults or errors on our part. If a template, course, or website we deliver is genuinely faulty, does not match its description, or we have failed to deliver what was agreed, please contact jayne@pixisite.com within a reasonable time. We will assess the issue and offer a fix, replacement, or partial/full refund as appropriate.
6.3 Your rights under New Zealand law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other New Zealand consumer protection law that cannot lawfully be excluded. Where you are acquiring goods or services for the purposes of a business (as defined under the Consumer Guarantees Act), you agree that the Act does not apply, to the extent permitted by law.
7. Intellectual Property
7.1 All content on the Site, including template designs, course materials, graphics, text, and branding (excluding content you supply to us), is owned by or licensed to Pixi Site and is protected by copyright and other intellectual property laws.
7.2 You may not copy, reproduce, distribute, or create derivative works from our templates, course materials, or Site content beyond the licence granted under Section 3 or 4, without our prior written permission.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, Pixi Site's total liability to you arising out of or in connection with any product, service, or these Terms is limited to the amount you paid for the relevant product or service.
8.2 To the maximum extent permitted by law, we exclude liability for any indirect, incidental, or consequential loss, including loss of profits, loss of data, or business interruption, arising from your use of our templates, courses, custom websites, or the Site.
8.3 We are not liable for outages, bugs, or issues arising from third-party platforms (e.g., Squarespace, Shopify, payment processors, hosting providers) that are outside our control.
8.4 Nothing in this section limits any liability that cannot lawfully be limited or excluded under New Zealand law.
9. Website Maintenance and Support
Unless a separate maintenance/support agreement is in place, we are not responsible for maintaining, updating, or fixing your website after project completion or template delivery. Ongoing support packages may be available on request.
10. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site or our products/services after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by, and construed in accordance with, the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand for any dispute arising from these Terms.
